Abstract EN

Liability insurance is one kind of the insurance from damages.

The idea this insurance depends on existence of a person who wants to protect himself from possibility of damaging third parties.

For this reason, he conclude an insurance contract in which the compensation from damaging others will transfer to the insurer.

Compulsory insurance from vehicle accidents is a contract aimed at guaranteeing damages to third parties from the insureds car.

Some laws exclude categories of insurance coverage in the area of liability insurance in vehicle accidents, such as the couples and children causing the accident, or the couples and children of the owner of the vehicle if he uses a driver.

From this point of view, the question arose whether these exceptions are constitutional or not? Are these exceptions compatible with the concept of liability insurance or not? The article tries to answer these questions.
