Abstract EN

The prevalence of dealing with Commercial Papers Discounting has not been free of problems risks for discounting bank specifically problems that are caused by the use of the complimentary bills discounting.

Due to the absence of legal texts related to the complimentary bills discounting, both French and Jordanian Jurisdictions played a great role in identifying the concept of these bills and specifying legal judgment and consequences of using them.

On the other hand, the recent application of cheques discounting by banks in France has gained the support of French Judiciary and seniors scholars.

However, the Jordanian Judiciary rejects the legitimary of cheques discounting despite the similarities of chques legal judgment in both countries.

This research presents and evaluates Judgments applied to discounting issues.
