Abstract EN

The Jordanian civil law did not discuss the contractual responsibility for the actions of an other directly, but indeed, there is a legal application for it in the civil law and other laws such as the commercial law and labor law so this study tried to investigate the suitability of the Jordanian legislator position, and the sufficiency of these applications to determine the features of this kind of responsibility.

This study aimed to identify the concept of the contractual responsibility, and the provisions and the bases of this responsibility and to identify the concept (an other) who wondered about him by the debtor, and to determine its legal base, and to examine and discuss the importance of the doctrinal theories such as the supposed mistake theory, and the almighty power theory, and searching in these theories, based on the direct action cases, and analyzing the text of the Jordanian civil code, and address the most important legal applications of contractual liability in the action of others, and finally reach to results and recommendations.
