The issue of proving real property is important, whether for legislator, judge or rights holders.

The legislator considered the documentary certificate of the requirements of the month-in-kind system when he stressed that the transfer, establishment or expiration of in-kind real estate rights on the occasion or by death must be done with a documented Of the heirs or recommended to them within legally defined deadlines.

Through this research, we deal with the concept of documentary testimony in Algerian legislation and its role in proving the transfer of the real estate heritage.
