Customary marriage is a social phenomenon that has become increasingly apparent in Algeria and the Arab countries, despite the explicit legal provisions that marriage contracts should be documented, making lawmakers in Algeria or Arab countries looking for legal solutions to document them and with them the judiciary which finds itself faced with a reality imposed by customary marriage recognition, As a result of the separation of classes, the customary marriage must be established before the courts.
