Abstract EN

This article aims to study texts subject to the exception of unconstitutionality.

And through the comparative study and the defenses referred to the Algerian Constitutional Council, the most important results were reached: the necessity of amending the current constitution and the organic law that defines the conditions of the exception of unconstitutionality, adopting the expanded tendency to push for unconstitutionality so that the right to do so for every natural or legal person, as well as for the judge, and to be challenged against any text that violates the constitution, including ordinary laws, ordinances and regulations.
