تبدو المعاملات الإلكترونية في الوقت الراهن كسهم التوجيه لترقية الإقتصاد الجديد: اقتصاد الإنترنيت أو الإقتصاد الافتراضي.
كما تعد التجارة الإلكترونية مستقبل المؤسساتوبالتالي مستقبل الدول بحيث تمثل مصدر لتدفقات هائلة الذي ينمو باستمرار و هذه النتيجة لا تخلو من أثر.
بالفعل هذا يعني أنه على غرار التجارة التقليدية لا بد من إخضاع التجارة الإلكترونية للضريبة.
نشهد اليوم تطورا كبيرا للتجارة الإلكترونية و الذي يدخل علاقة معقدة ما بين مجالين مختلفين تماما.
حيث تبدو بعض المفاهيم الجبائية مبدئيا غير مطابقة و يبرز هكذا إنفراد التجارة الإلكترونية و هذا ما يضع الإدارة الجبائية أمام تحديات متمثلة في إمكانية فرض ضرائب على معاملات تجارية في محيط إفتراضيو مواجهة إمكانيات جديدة للغش الضريبي: عدم تجسيد المعاملاتمن جهة و إمكانية إخفاءالعمليات من جهة أخرى يجعل من المستحيل للغاية تطبيق المفاهيم المعتادة للحدود الجبائية و السيادة الوطنية في المسائل الضريبية.
فلهذا لابد أن تساير الجباية مختلف التطورات لإيجاد وسيلة لفرض الضريبة على هذا النوع الجديد للتجارة و تفادي الخروج من مبدأ المساواة الذي يرتكز عليه كل نظام جبائي
Abstract EN
Electronic transactions, nowadays, appear as the vector for promoting the new economy: the net economy or the virtual economy.
E-commerce is the future of companies and therefore of the States, it represents a source of enormous financial flows, which never stop growing, and this observation has a significant effect.
Indeed, this implies that just like the taxation of traditional commerce, e-commerce should also be taxed.
Today, we are witnessing a great development of electronic commerce that triggers a complex relationship between two fields completely different.
Indeed, some tax concepts seem fundamentally incompatible and reveal the originality of electronic commerce, which puts the tax administration in the challenge of imposing successfully transactions in a virtual space and facing new opportunities for tax evasion: the dematerialization of transactions and the anonymity of transactions make it extremely impossible to apply the usual concepts of fiscal frontiers and national sovereignty in tax matters.
This is why the tax system must be in line with the developments and thus find other means of taxation for this new form of trade in compliance with the principle of equality on which every tax system is based.

RESUME: Les transactions électroniques apparaissent de nos jours comme le vecteur de promotion de la nouvelle économie: l'économie du net ou l'économie virtuelle.
Le commerce électronique est l'avenir des entreprises et donc celui des Etats, il représente une source d'énormes flux financiers qui ne cessent de croitre et cette constatation n'est pas nulle d'effet.
Effectivement, ceci implique que tout comme l'imposition du commerce traditionnel il faudrait également soumettre le commerce électronique à l'impôt.
Nous assistons, aujourd'hui, à un grand développement du commerce électronique qui introduit une relation complexe entre deux domaines totalement différents.
En effet, certains concepts fiscaux semblent fondamentalement incompatibles et révèlent l'originalité du commerce électronique, ce qui met l'administration fiscale dans le défi de réussir l'imposition des opérations dans un espace virtuel et faire face aux nouvelles possibilités de fraude fiscale: la dématérialisation des transactions et l'anonymat des opérations rendent fortement impossible l'application des concepts habituels de frontière fiscale et de souveraineté nationale en matière d'impôt.
C'est pourquoi la fiscalité doit aller dans le même sens que les développements et trouver ainsi un moyen d'imposition de cette nouvelle forme de commerce pour ne pas déroger au principe d'égalité sur lequel se base tout système fiscal.
