As a general rule, the Commercial Agency is considered as a mutual agreement.

Hence, nothing could prevent both the principal and the authorized agent to terminate the commercial agency agreement which emerged from the convergence of their will, in accordance with the principle of pacta sunt servanda.

As an exception, the authorized agent may terminate such agreement by unilateral will.

Equally, the principal may, at any time, unilaterally terminate the commercial agent agreement.

The legislator's opinion from allowing such settlement is to protect both parties as long as the agency is always founded on mutual trust between the principal and the agent.

If the principal looses trust in his agent, he may either dismiss him if he is no longer interested in his continuation, or cancel the renewal of his agreement, taking into consideration provisions related to compensation for termination.
