In the context of the public interest and the harmonious and regular functioning of public services, the Algerian legislator has given the administration the right to resort to direct execution, this privilege is an exception to the general rule, which requires that the administration has recourse to direct execution by judicial means, and the use of this privilege by the administration supposes that the administrative decision is legitimate.

Therefore, the use of this privilege by the administration is subject to provisions and conditions, if they are not respected, the execution of the decision may be suspended by the judiciary.
