تعتبر المحكمة الجنائية الدولية سلطة قضائية دائمة حيث يمكن محاكمة قادة إسرائيل السياسيين و العسكريين أمامها عن الجرائم التي ارتكبوها في الأراضي الفلسطينية حيث أن تلك الجرائم لا تسقط بالتقادم.
و بدأ نفاذ المحكمة الجنائية الدولية بالنسبة لفلسطين في 01 أفريل2015 ما منح المحكمة ولاية على الجرائم الجسيمة التي تخرق القانون الدولي و تشمل جرائم الحرب و الجرائم ضد الإنسانية المرتكبة على الأراضي الفلسطينية.
و لقد أعلن مكتب المدعي لدى المحكمة الجنائية الدولية الشروع في إجراء دراسة أولية للوضع في فلسطين على أساس الإعلان الفلسطيني المودع لدى المحكمة بموجب المادة 12فقرة03 بقبول اختصاص المحكمة الجنائية بأثر رجعي يعود لتاريخ 13جوان 2014.

is a permanent judiciary, whereIsrael'spolitical and military leaders canbeprosecuted for crimes committed in the Palestinianterritories, as these crimes are not neglected over time.
The International Criminal Court (ICC) enteredinto force on April 10, 2015, giving the court jurisdiction over serious crimes thatviolate international law, includingwar crimes and crimes againsthumanitycommitted in the Palestinianterritories.
yet The Office of the Prosecutor of the Criminal Court has announced the initiation of a preliminarystudy of the situation in Palestine on the basis of the Palestinian declaration submitted to the Court under article 12, paragraph 30, to accept the jurisdiction of the Criminal Court retroactively dated 13 June 2014.
