Human rights and fundamental liberties will be fully guaranteed only under a democratic system that respects these rights and provides them with the necessary protection to enable the people to participate in the political decisions of their country.

Unlike dictatorial systems that do not respect the civil and political rights of their citizens, especially civil and political ones, which eliminate a peaceful alternation in power and will have negative consequences on human rights in these countries.

This has led most states that want to establish democratic systems to adopt transitional justice as a new mechanism to deal with these flagrantly violations of human rights and realize the principle of sovereignty of the law during the phase of the democratic transition.
