This study aims to clarify the legal model of the offense of smuggling of migrants, in the perspective of the Protocol against the smuggling of migrants by land, air and sea, supplementing the United Nations Convention against Transnational Organized Crime and the law n ° 09-01 modifying and supplementing the penal code, in order to identify points of agreement and disagreement.

the study allowed us to determine the adjective of the perpetrator of the offense of smuggling of migrants and the nature of the criminal behavior, and the penalties prescribed for him with an explanation of their aggravating and mitigating circumstances.
