This article aims to study the effectiveness of the parliamentary opposition, through the referral mechanism according to the 2016 constitution.

The study stages are as follows: First: the conceptual framework for the parliamentary opposition and oversight of the constitutionality of laws, then the role of the parliamentary opposition in political control of the constitutionality of laws in Algeria, followed by referral as a mechanism for political oversight of the constitutionality of laws as an element that examines the procedural side The objective of the referral mechanism, and finally evaluation of the role of the parliamentary opposition in the political control of the constitutionality of laws through the referral mechanism, as a result of this study, we concluded that the authority worked to weaken the opposition as reflected negatively on the quality of legislative work.
