Abstract EN

This article aims to study the constitutional and legal protection of regulations in Algerian and French legislation.

It was clear from the comparison between the two legislations that the Algerian legislation followed his French counterpart in all the mechanisms that the latter had put in place to protect the regulations at the expense of the law.

He restricted the areas of law and expanded the areas of regulations, and gave the government mechanisms to defend and protect the regulations, and did not give parliament any mechanism to defend the law, which violates the principle of balance between the two authorities.

He also established a constitutional council specifically for the control of Parliament, and was keen to subordinate it to the executive authority.

He subjected all parliament activities to control and did not subject the organizations to any monitoring.
