In this article, we wondred about the legal means thatwere used to stop the execution of the death penalty in Algeria since 1993.

This is in light of data that reflected Algeria's retention of the penalty at the legislative level, in exchange for an international commitment requiring the harmonization of national legislation with international agreements under international accountability.

We concluded that the suspension of execution was not at the level of the criminalization provisions and the implementation of the abolition of the punishment.

Rather, after the implementation of some temporary interim legal solutions, the law 05/04 was issued, which requires regulatory texts to implement it.

The Executive Authority, after that law, expressed its position on the international commitment and decided not to issue these texts, and this prevented the possibility of carrying out the penalty
