In addition to its regulatory rules, the marine fishing act n°01-11 includes also penal rules, which the algerian legislator aims behind to provide legal protection to the marine fishing activity through establishing deterrent penalties, whether it is custodial penalties or financial ones (fines) or both together with the order of the seizure of fish, fishing machinary and equipement and in some cases, the fishing vessel also.

The aim behind the penal protection is not only the good exploitation of fauna and flora, but also the ensurence of sustainable exploitation and the fight against all types of crimes threatening the national economy, especially smuggling which results in economy depletion and collapse.
