Telework is a new system distinct from traditional work; it is carried out at the teleworker’s home or outside the employer’s intitution using information and communication technology.

This new concept gives more freedom to the worker and more legal subordination to the authority of the employer, which has effected control over the worker's private , so that work has become a mixture between private and professional life.

The Algerian legislator organized the home as a form of telework according to Executive Decree 97-474, but this legislation did not regulate the new perception of telework.

It does not provide for control mechanisms, and does not protect the privacy of the teleworker, which has led us to resort to comparative law and jurisprudence.
