Works done in the framework of a contract or labor relationship raises difficulties in determining ownership of the rights contained in it based on a collision between the principles governing labor law and the rules governing copyright.

In the labor code, the fruits of the intellectual production belong to the employer in return for payment of wages; unlike in the labor code, the license to exploit financial rights has a narrow interpretation, as it is limited only to the forms of exploitation agreed in the contact.

These and other difficulties are what this study tries to shed light on in order to find harmony and compatibility between two seemingly conflicting positions: the status of the worker and the status of the creator.
