Labor mediation imposed itself as emerged as an alternative measure to resolve collective labor disputes, It has been adopted by several comparative legislation.

However despites the Algerian legislator's recognition of it among the labor code, it remained deficient duo to the omission of its organization and the lack of the detailed rules to have access to it.

The study showed that time and procedural flexibility should be taken into consideration in order to implement the labor mediation efficiently, in addition to its advantages and integrated functions.

Moreover, the Algerian legislator should reconsider the labor mediation laws especially those relating to the mediator and his fees, implementation of the mediation agreement and its procedures with the possibility od the judicial control.
