إلا أنه قد أثبتت التجربة القضائية في المجال الاجتماعي مساهمة القاضي في زعزعة الأمن القانوني إما حماية للعامل و إما مساندة للمستخدم.
Abstract EN
The judge plays an active role in establishing legal security through his commitment to respect the spirit of the legal text.
However, judicial experience in the social field has demonstrated the judge's contribution to undermining legal security, either to protect the worker or to support the employer.
