The change in the nature of constitutional oversight exercised by the French constitutional council, effectively monitoring the decisions of the council of state and the court of cassation, has transformed the constitutional question of primary relevance by examining the law's conformity with the constitution into a form of judicial challenge in the judicial decisions of the supreme councils of administrative and ordinary judicial organizations these facts, taken from the functioning of the French constitutional council, call for taking them into consideration in order to enable the Algerian constitutional council to take over the top of the hierarchy of judicial organization.

in the case of a constitutional court or a higher council in accordance with the traditional constitutional system of justice, although this is unlikely, with the constitutional bill's provision that the constitutional council should be kept outside judicial engineering, it may not conceal profound changes in the nature of the constitutional council's work and its relationship with the components of judicial organization, all of which are related to the changes that reached his terms of reference, the duration of his intervention, and most important of all this is the liquidation mechanism that the Algerian constitutional legislator has embraced.
