Abstract EN

The preservation of the waqf property and its protection are considered as main objectives, in order to achieve the charitable purposes and work on its promotion and investment, especially when it is a legal entity.

To realize this aim, the Algerian legislator has provided the waqf with a particular legal and penal protection in order to save it and a distinct preservation from other contracts and forms of property, this protection has not been restricted to the legislations governing the endowments, but also, penal protection by virtue of the law, to ensure the safety of the waqf property and protect it from any abuse, so there are multiple forms of protection of waqf properties that are due to different actions such as the wrongdoing of foreigners or the principal of endowments, or the abuse of the two parties.

That’s why the jurisdiction tried to provide protection to waqf properties through addressing its disposition, seizure or reorientation attempts, because these practices are incompatible with the noble objective of the waqf.
