تعد التجارة الإلكترونية من بين المجالات الناشئة للاستثمار التي لها آفاق واعدة بحيث أصبحت تنافس نظيرتها التقليدية في وقت اخذ فيه الاقتصاد طابعا رقميا و سخرت تكنولوجيا الإعلام و الاتصال لترقيتها كيفا وكما فاكتمل تكوين بنيانها بتشكيل مجتمعا مستقلا له بيئة افتراضية وموردين و مستهلكين إلكترونيين.
ترتب عن ذلك الاستقلال عدم قدرة القواعد العامة على ملاءمة و استيعاب ما يميز التجارة الالكترونية من خصوصية كما اقتضى حتمية إفرادها بقواعد قانونية نوعية و مستقلة تستجيب لتلك الخصوصية و تساهم في ترقيتها.
لكن ضل تنظيم التجارة الالكترونية في الجزائر من الناحية التشريعية محتشما ولم يرقى إلى مستوى التوفيق بين تقنيات تكنولوجيا المعلومات و الاتصال و ما تتطلبه ممارسات التجارة الالكترونية من خصوصية مما جعلها بعيدة عن التطلعات و تحقيق الآفاق المتوخات منها وقد أبانت جائحة كورونا عن ذلك القصور.
Abstract EN
E-commerce (electronic commerce) is one of the emerging areas of investment with promising prospects, so that competition with its traditional counterpart became a time when the economy became a digital.
Information and communication technology has been harnessed to upgrade it as well.
its architecture has been shaped by the creation of an independent society with a virtual environment, suppliers and consumers.
As a result of that independence, the inability of general rules to accommodate the specificity of electronic commerce; Responds to that privacy and contributes to its promotion.
However, the regulation of electronic commerce in Algeria has been misled in legislative terms.
It has not been up to the harmonization of Information and communication technologies and the privacy that e-commerce practices require; this has made them far from the expectations and the achievement of the horizons they are intended to achieve.
the Corona pandemic (COVID-19) has shown that inadequacy.
