لاشك في أن الاعتراف بحق المتقاضين في الطعن بعدم الدستورية يعد من أوكد الضمانات الكفيلة بحماية حقوق و حريات الأفراد و قد تجسد هذا الحق بصدور التعديل الدستوري لسنة 2016 حيث أقر و لأول مرة الدفع بعدم الدستورية ثم تلاه صدور القانون العضوي رقم 18-16 المحدد لشروط و كيفية تطبيق هذه الآلية.
و في هذا الإطار جاءت هذه الورقة البحثية من أجل الوقوف على مدى توفيق المشرع في تنظيم آلية الدفع بعدم الدستورية بما يعزز فعاليتها في حماية الحقوق و الحريات و هذا من خلال بيان أبرز القيود و العوائق التي تعتري المسألة و تقديم الحلول المقترحة لذلك مستخدمين المنهج الوصفي و منهج تحليل الموضوع و كذا الاستعانة بأدوات المنهج المقارن وفقا لما يحقق الغرض من البحث.
و قد خلصنا إلى وجود عوائق تحد من فعالية هذه الآلية في حماية الحقوق و الحريات.
Abstract EN
Supporting unconstitutionality is one of the most important guarantees that protect the rights and freedoms guaranteed by the constitution.
In order to achieve this goal, the Constitutional amendment of 2016 permitted the litigants within the lawsuit to Challenge the constitutionality of legislative provisions before the regular of administrative courts.
This later will pass it to the Supreme Court or the council according to the case which will in turn pass it to Constitutional Council if it meets all the conditions and procedures stipulated by the membership law No 16-18.
Despite the importance of the law defining the conditions and procedures upon which the application of unconstitutionality depends, these requirements carry several obstacles that limit their overall effectiveness as a mechanism to address the legislative requirements that violate the rights and freedoms of citizens guaranteed by the constitution, then confiscate and preventing it from achieving constitutional justice.

L'exception d'inconstitutionnalité est l'une des garanties les plus importantes qui protègent les droits et libertés garantis par la Constitution.
La révision constitutionnelle de 2016 a permis aux justiciables de contester la constitutionnalité des dispositions législatives devant les juridictions.
Cette contestation est examinée par le Conseil constitutionnel si elle remplit les conditions et les procédures prévues par la loi organique n° 18-16.
Cependant, malgré l'importance du procédé quelques obstacles l’entour qui sont susceptibles d’en limiter l’efficacité en tant que mécanisme répondant aux exigences législatives en termes de droits et libertés des citoyens garantis par la Constitution
