على الرغم من أن الجزائر تملك نظاما تشريعيا حديثا في مجال الحجز على السفن إلا أن شركات التأمين الوطنية ذات الرأسمال العمومي تبقى عاجزة عن حماية مصالحها في مجال عقود التأمين البحري على البضائع و تسجل بالتالي كل سنة خسائر مالية معتبرة وذلك جراء عدم دفع السفن الأجنبية المكلفة بتوريد هذه البضائع لما عليها من ديون تجاه المؤمنين الجزائريين بفعل الخسائر اللاحقة بها و مغادرتها للموانئ الجزائرية بعجالة تضاف إليها المناورات التي تلجأ إليها نوادي الحماية التي تملك مكاتب مراسلة في الجزائر بهدف منع توقيع الحجز على سفن أعضائها من المجهزين المدينين تجاه شركات التأمين الوطنية.
تهدف هذه الدراسة إلى تشخيص طبيعة و أسباب هذا العجز كما تقترح حلولا ذات طبيعة تشريعية و تنظيمية و عملية للتصدي لهذا الواقع السلبي.
Abstract EN
Despite the modern legal regime, in terms of conspiratorial seizures of ships owned by Algeria, the insurance companies, those with public capital, show a flagrant inability to protect their interests arising from maritime insurance contracts with debts to the foreign carriers and ship-owners, registering significant annual losses.
The rapid and hasty departure of foreign ships from Algerian ports after unloading of freight, fears of being subject to provisional attachment for damage noted on the goods and without payment of damages to Algerian insurers, as well as maneuvers emanating from protection and compensation clubs (P&C), which have liaison offices in Algeria, and which generally contest the validity of the guarantees which have been put in place, after requests for seizure on ship, are the main causes of this state of affairs.
This study is of both theoretical and practical interest, tends to diagnose the nature and causes of this situation and offers solutions of a legal, organizational and practical nature to remedy them.
