طبقا للأمر 74 / 75 المؤرخ في 12/11/1974 المتضمن إعداد مسح الأراضي العام و تأسيس السجل العقاري تبنى المشرع الجزائري نظام الشهر العيني الذي يقوم على إجراءات متسلسلة و متوالية تبدأ بعملية المسح العام للأراضي تليها عملية تأسيس السجل العقاري و بموجبها تتم عملية تسليم الدفتر العقاري التي تعتبر العملية القانونية النهائية و المرجع في كل عملية لاحقة التي تضمن استقرار الملكية العقارية ليصبح بذلك الدفتر العقاري السند الوحيد المثبت للملكية العقارية في المناطق الممسوحة و يتولى تحريره و تسليمه المحافظ العقاري المختص إقليميا.
Abstract EN
In accordance with ordinance 75-74 of 12/11/1974 containing the preparation of the general survey and the establishment of the land register, the Algerian legislator adopted the system of publicity in kind, which is based on sequential procedures and consecutive that begin with the general surveying process, followed by the land registry process and by which the book delivery process is completed.
Real estate, which is the final legal process and the benchmark in each subsequent process, which guarantees the stability of real estate property, so that the real estate book becomes the only basis for real estate property in the areas studied, and it is edited and delivered by the relevant real estate portfolios at regional level.

Conformément à l'ordonnance 75-74 du 12/11/1974 portant établissement du cadastre général et institution du livre foncier, le législateur algérien a adopté le système de publicité réelle basé sur des procedures séquentielles et consécutives qui commencent par le processus d'arpentage général, suivies par le processus d'établissement du register foncier soldées par la remise du livre foncier.
Ce processus juridique garantit la stabilité de la propriété immobilière, de sorte que le livre immobilier devient la seule base pour la propriété immobilière.
