تقوم فلسفة اللامركزية الإدارية على خلق هامش من التوازن بين الهيئة المحلية و السلطة المركزية من خلال بعث إستقلالية الجماعات المحلية و تعزيزها من جانب، و بمنح السلطة المركزية وصاية على هذه الوحدات من جانب آخر.
و طبيعي أن يكون نجاح اللامركزية المأمولة مرهون بتحقق هذا التوازن، فالإستقلالية المطلقة للهيئات المحلية تشكل تهديدا مباشرا لدولة القانون و لسيادتها، كما أن الوصاية المتشددة من شأنها إلغاء وجود الهيئات المحلية و تشويه الطبيعة القانونية والواقعية للتنظيم الإداري اللامركزي، وعليه فمن الضروري الإبقاء على سلطة الدولة على الصعيد المحلي دون إلغاء وجود تلك الهيئات المحلية أو إعاقتها.
و الدارس للنصوص القانونية الناظمة للوصاية الإدارية على الجماعات المحلية في الجزائر يخلص إلى وجود خلل و قصور يعتريها سواءا في مبانيها و ألفاضها أو حتى في مضامينها و مقاصدها وهي الإختلالات التي عادت بالسلب على نشاط تلك الوحدات بل و على طبيعة التنظيم الإداري المنتهج.
Abstract EN
The philosophy of administrative decentralization is based on creating a margin of balance between the local authority and the central authority by creating and strengthening the independence of local groups on the one hand, and by granting the central authority guardianship of the seunits on the other.
Of course, the success of the hoped for decentralization depends on achieving this balance.
The absolute independence of local bodies constitutes a direct threat to the rule of law and its sovereignty, Also, strict guardianship would cancel the presence of local authorities and distort the legal and realistic nature of decentralized administrative organization.
The refore, it is necessary to maintain the state’ sauthority at the local level with out abolishing the presence of these local bodies or obstructing them.
The student of the légal texts governing administrative guardianship of the local groups in Algeria concludes that there are defects and shortcomings in their buildings and words, or even in their contents and intentions, which are the defects that negatively affected the activity of the seunits and even the nature of the organized administrative organization.
Abstract FRE
La philosophie de la décentralisation administrative repose sur la création d'une marge d'équilibre entre l'autorité locale et l'autorité centrale en créant et en renforçant l'indépendance des groupes locaux d'une part, et en confiant à l'autorité centrale le contrôle de ces unités d'autre part.
Bien entendu, le succès de la décentralisation espérée dépend de la réalisation de cet équilibre.
L'indépendance absolue des collectivités locales constitue une menace directe pour l'État de droit et sa souveraineté.
En outre, une tutelle stricte annulerait la présence d'organes locaux et fausserait la nature juridique et réaliste de l'organisation administrative décentralisée.
Il est donc nécessaire de maintenir l’autorité de l’État au niveau local sans pour autant abolir la présence de ces organes locaux..
