Abstract EN

The scientific and technological progress that has spread all over the world led to the emergence of new types of damages caused by products to consumers, and this was a motive to search for the responsibility of people who are the source of these products as manufacturers and distributors, and thus gradually the responsibility of the product emerged and was approved by most legislation, including the Algerian legislation In Law 10-10 amending and supplementing the Civil Code within Article 140 bis of it, but the legislator's restriction to one article to determine this responsibility without elaborating in its provisions shows that there are many problems regarding how the product is held accountable, as well as ensuring the rights of those affected.

For this reason, the legislator should rectify this by issuing regulatory texts stating how to implement this article or adding other articles to the civil law.

Les progrès scientifiques et technologiques qui se sont répandus dans le monde entier ont conduit à l'émergence de nouveaux types de dommages causés par les produits aux consommateurs, et cela a été un motif de rechercher la responsabilité des personnes qui sont à l'origine de ces produits en tant que fabricants et distributeurs, et donc progressivement la responsabilité du produit a émergé et a été approuvée par la plupart des législations, y compris la législation algérienne (Art.

Toutefois, l’article précité ne détermine avec précision le produit qui pourrait nuire.

Pour cette raison, le législateur devrait y remédier en édictant des textes réglementaires précisant comment mettre en oeuvre cet article ou en ajoutant d'autres articles au code civil.
