يقتصر اختصاص المحكمة الجنائية الدولية على أشد الجرائم خطورة موضع اهتمام المجتمع الدولي و للمحكمة بموجب هذا النظام الأساسي اختصاص النظر في الجرائم التالية : جريمة الإبادة الجماعية الجرائم ضد الإنسانية جرائم الحرب جرائم العدوان من وجهة نظر المواد : 6 و 7 و 8 و 8 مكرر من هذا النظام الأساسي، و نظرا لأن الاعتداء على فرق الإغاثة الإنسانية يمكن أن يشكل في جميع الحالات إحدى هذه الجرائم فإن ذلك مبررا كافيا لإدراج ما يتعلق بهذا النوع من الاعتداءات ضمن اختصاص المحكمة الجنائية الدوليـــــة باعتبارها جرائم مستوجبة للمسؤولية الجنائية الدولية.

The Jurisdiction of the International Criminal Court is limited to the most dangerous crimes of international community interest, under this Statute, the court considers the following offenses : the genocide_ crimes against humanity_ war crimes_ aggression crimes according to articles 6_7_8_8 bis of this Statute, since the prevention of humanitarian relief can Constitute in all cases one of these crimes ; That'sa Sufficient justification to insert everything related to the violation For humanitarian workers within the jurisdiction of the International criminal court ,as crimes under international criminal responsibility.

La juridiction de la Cour pénale internationale est limitée aux crimes les plus dangereux d'intérêt communautaire, en vertu de ce statut, elle examine les infractions suivantes : le génocide, crimes contre l'humanité, crimes de guerre, crimes d'agression conformément aux articles 6, 7, 8 et 8 bis du statut de la Cour, puisque la prévention des secours humanitaires peut constituer dans tous les cas un de ces crimes ; C’est une justification suffisante pour insérer tout ce qui concerne la violation des missions de secours et des travailleurs humanitaires relevant de la compétence de la Cour pénale internationale (crimes de responsabilité pénale internationale).
