Abstract EN

Freedom of mouvment and travel is one of the personal liberties protected by the contitution.

Therfore, the Algerian legislator intervened and made the autority to prohibit individuals from traveling from the jurisdiction of the judiciary power only, and set out in special provisions the conditions that must be met to issue the travel ban, whether during the preliminary investigation stage conducted by the judicial police or during the judicial investigation stage or during the trial period.

The perpuse of this research is to identify judicial authorities that are empowered by law to issue an order of prohibition from leaving the national territory in the Algerian legislation, and the conditions and procedures for resorting to this procedure.

It has been concluded through this study that the Algerian law still contains many legal vaccum to address certain situations that may affect the right of individuals to move constitutionally dedicated.

La liberté de circulation et de voyage est une des libertés individuelles protégée par la constitution, par conséquent, le législateur algérien est intervenu et a institué le pouvoir d’empêcher les individus de voyager pour le rendre du ressort du pouvoir judiciaire uniquement et, a également exposé dans des dispositions spéciales les conditions à remplir pour pouvoir ordonné l’interdiction de voyager et ce, du début de l’instruction à la prise de décision.
