The growing phenomenon of work in early childhood, prompted the International Labor Organization to issue standards aimed at protecting a minor from all forms of exploitation in the field of work, and from using it in dangerous work, or harmful to his health or his right to education, by setting a minimum age for employment, And to detemrmine the nature of the work assigned to them that suits their age and capabilities.

The Algerian labor law contains provisions for the work of a minor, which are considered from the public order and impose restrictions related to the age of employment, parental licensing, and the nature of the forbidden work, to conform to international standards, but what distinguishes them is that they are few so that they do not address all the issues referred to in international standards, This made it a mere superficial treatment that fell short of the legal regulation in its true sense .

La recrudescence du travail des enfants a conduit l’Organisation Internationale du Travail à arrêter un certain nombre de mesures visant à garantir le droit à la scolarité mais aussi à protéger les mineurs de toute forme d’exploitation.

Ces mesures consistent principalement en la limitation de l’âge minimum d’emploi et l’élaboration d’une liste de postes à confier aux enfants, en adéquation avec leur âge et leurs capacités.

Ces mesures sont considérées comme d’ordre public, le législateur algérien a entouré le travail des mineurs de plusieurs restrictions liées à l’âge, à l’autorisation paternelle et à la nature des emplois à confier à cette frange.

Toutefois, cet encadrement juridique est au deçà des attentes d’autant que les mesures décidées sont de nombre et de champ restreints.
