Abstract EN

The modern repressive policy tends to reduce the recourse to short-term freedom repressive punishment.

Experience has proved its uselessness in meeting the goals of punishment such as dissuasion, reform and habilitation and the search for other punishment alternatives in order to avoid its shortcomings and reduce its negative impacts.

These alternative punishments are put in a context of modern single punishment that has proven efficient in facing the criminal phenomenon.

This alternative brings together the punishment objectives such as convicting the offenders for the sake of dissuasion and reform taking into account human considerations that aim at preserving human rights by getting recourse to it in need.

That is why many countries among which Algeria have attempted to seek for punishment alternatives instead of short-term freedom repressive punishments in view of reaching more efficiency in attaining modern punishment goals and trying to avoid bad effects of short-term freedom repressive punishments.

La politique pénale moderne s’oriente, en matière de peines criminelles, vers une limitation de l’utilisation des peines privative de liberté de courte durée, favorisant ainsi la réintégration sociale et la réadaptation.

Les peines alternatives ont prouvés leurs efficacité contre le phénomène criminel, car elles prennent en considération les l’aspect humain qui vise à protéger les droits de l’homme.

De ce fait, plusieurs pays, dont l’Algérie s’efforcent a trouver les alternatives aux peines privatives de liberté de courte durée et ce, afin concrétiser les objectifs que se fixe la peine criminelle dans sa forme moderne.
