إن تنامي الظاهرة الإجرامية و بروز أصناف حديثة من الجرائم التي لم تكن معروفة سابقا نتيجة التطور الذي تشهده البشرية و بعدما أثبت الواقع العملي صعوبة مجابهة هيئة القضاء للكم الهائل من القضايا المعروضة أمامها و هو ما أدى إلى سرعة البحث عن وسائل بديلة عن المتابعة الجزائية عساها تسهم في الحد من الجريمة و من بين أهم هذه الوسائل نجد نظام التسوية الجنائية الذي أقره المشرع الفرنسي في قانونه الجزائي و الذي يلعب دورا فعالا في السياسة الجنائية الحديثة نظرا لمزاياها الكثيرة سواء في تخفيف العبء على القضاء و تبسيط و تسريع الإجراءات و ما تحققه من نشر للتسامح و السلم بين أطياف المجتمع.
Abstract EN
The growing criminal phenomenon and the emergence of modern types of crimes previously unknown are the result of human development.
In practice, the judiciary has proved difficult to deal with the vast number of cases before it, which has led to the rapid search for alternative means of penal follow-up that contribute to the reduction of crime.
Among the most important are the Criminal settlement system approved by the French legislature in its penal code, which plays an active role in modern criminal policy because of its many advantages, whether in reducing the burden on the judiciary, simplifying and accelerating procedures, and spreading tolerance and peace among the community.

La croissance du phénomène criminel et l’émergence de nouveau genre d’infractions jusque-là inconnues, sont le résultat du développement humain.
En pratique, le pouvoir judiciaire a très vite montré ses limites pour faire face au grand nombre de poursuites dont il était saisi, ce qui a conduit à la recherche de solutions alternatives au suivi pénal, qui pourraient contribuer à la réduction de la criminalité.
Parmi ces solutions, on cite le système de compensation pénale approuvé par le législateur français dans son code pénal, qui joue un rôle actif dans la politique pénale moderne en raison de ses nombreux avantages, qu'il s'agisse d'alléger le fardeau judiciaire, de simplifier et d'accélérer les procédures ou de propager la tolérance et la paix dans la société.
