تكتسي جل الاختراعات أهمية بالغة لما لها دور أساسي في تطور الحياة الإنسانية فتعد البيوتكنولوجيا الوجه الجديد لهذه الاختراعات.
و ذلك نظرا لاتساع المجالات التي تستخدم فيها إلا أن هذه الاختراعات شأنها شأن أي اختراع لابد أن تتوافر فيه شروط الحماية.
حيث تتخذ التشريعات مواقف متباينة في تحديدها للاختراعات البيوتكنولوجية التي تقبل الحماية عن طريق البراءة بحسب اختلاف مصالحها فبينما تميل الدول المتقدمة إلى التوسع في تحديد مجالات الابتكارات التي تقبل الحماية عن طريق البراءة تميل الدول النامية إلى التضييق من ذلك.
الأمر الذي دعانا إلى البحث عن قابلية الاختراعات البيوتكنولوجية للحماية عن طريق البراءة.
Abstract EN
Most of the inventions are extremely important because they have a fundamental role in the development of human life, so biotechnology is the new face of these inventions, due to the wide areas in which they are used.
However, these inventions like any invention must meet the conditions for protection.
Legislation takes different positions in determining biotechnological inventions that accept protection by patent according to their different interests.
While developed countries tend to expand in the areas of innovations that accept patent protection, developing countries tend to narrow it.
Which led us to search for the susceptibility of biotechnological inventions to patent protection.
