إذا كانت أحكام الضمان العشري الذي يقع على المهندس المعماري و المقاول و غيرهم من المتدخلين في مجال البناء-عما يظهر في ما شيدوه من مباني و منشآت ثابتة أخرى من عيب يهدد سلامته أو متانته أو من تهدم كلي أو جزئي خلال عشرة سنوات من تسليم العمل لصاحبه-من النظام العام إذ يقع باطلا كل اتفاق يقضي بخلافها خاصة أن العلاقات التي تحكم المتدخلين في عملية البناء لا تنتهي بانتهاء العمل المطلوب و إنما تمتد إلى ما بعد ذلك فإن الأمر يختلف في بعض التشريعات المقارنة كالتشريع المصري و كذا التشريع و الفقه الفرنسيين حيث تعارضت الآراء بخصوص جواز تعديل أحكام الضمان العشري لفترة طويلة في حالات استثنائية قبل صدور قانون 04 جانفي 1978 بينما بقي المشرع الجزائري على فكرة اعتباره من النظام العام لا يجوز نقضه أو تعديله أو الإعفاء منه حماية للمصلحة الخاصة لصاحب العمل بوجه خاص و المصلحة العامة بوجه عام.
Abstract EN
If the ten-year collateral guarantee which is imposed on the architect, contractor and other interveners in the field of construction - for the defects that threatens the safety or durability of the constructed buildings and other fixed structures they had participated in building, or from total or partial destruction within ten years of the delivery of work to its owner - is derived from the public order.
For which any agreement contrary to it is considered invalid; but the situation is different in French legislation and jurisprudence, where views diverged regarding the possibility of amending the provisions of the ten-year collateral guarantee for a long time in exceptional cases before the enactment of the Law of January 04, 1978, while the Algerian legislator remained on the idea of considering it as part of the public order that must not be revoked, amended or exempted for the private interest of the building owner in particular and the public interest in general.

Les dispositions de la garantie décennale imposée aux intervenants dans le cadre de la construction -concernant les défauts du bâtiment qu’ils ont construit et des autres installations fixes qui menacent sa sécurité ou sa durabilité, ou d'une destruction totale ou partielle dans les dix ans suivant la remise des travaux à son propriétaire – est d'ordre public ; et tout accord invoquant le contraire est nul et non avenu, d'autant que les relations qui régissent les intervenants dans le processus de construction ne s’achèvent pas avec la fin des travaux requis, mais s'étendent au-delà.
La question diffère dans d’autres législations, telles que la législation égyptienne ou la législation et la jurisprudence françaises, quant à la possibilité de modifier les dispositions de la garantie décennale dans des cas exceptionnels avant la promulgation de la loi du 04 janvier 1978, alors que le législateur algérien continue à la considérer d’ordre public ; il n'est pas permis de la réfuter, de la modifier ou de s’en exonérer, afin de protéger l'intérêt personnel du maitre de l’ouvrage en particulier, et l'intérêt public en général.
