يعتبر هذا المقال مقاربة لمفهوم إشكالية البحث الذي يبقى محل جدال ناتج عن المواجهة في القراءات بين الباحثين في العلوم القانونية بوجه خاص و الباحثين في العلوم الاجتماعية بوجه عام.
و تتعلق النقطة الخلافية في كون المشكلة البحثية حسب الاتجاه الأول تقتصر على مجرد طرح السؤال الاشكالي في شكل جملة استفهامية قصيرة و محددة.
أما الاتجاه الآخر فهو يعتمد على تصور أوسع نطاق يتخذ شكل مبادرة فكرية و منهجية مركبة تتضمن مسارا محددا للموضوع محل البحث تبدأ بالسؤال الاشكالي و أسئلة البحث التي يطرحها و الفرضيات التي يثيرها و تتطلب توظيف و تبرير استعمال عدد من المعلومات المتباعدة أحيانا لإبراز الروابط المنطقية التي تساهم في تسليط الضوء على عناصر الموضوع و شروطه قصد تحقيق التطوير العلمي و التجديد المعرفي.
Abstract EN
This article is an approach to the concept of research problem which remains subject to a doctrinal controversy resulting from the confrontation of readings emanating from researchers in the area of legal sciences, in particular, and others in the area of social sciences, in general.
This approach highlights the problem dealt with in a research study which is limited, for the former, to state the problem in the form of a short sentence that heralds the central question that, in turn, determines the objective of the research under study.
For the latter, however, it is presented in the form of a complex intellectual and methodological initiative inducing a specific path of the research subject, the questions it raises and the hypotheses it formulates.
It also, requires the justification of the use of a number of ideas that are sometimes divergent to highlight the logical links between the elements of a subject and its conditions.

Cet article est une approche du concept de « problématique de recherche », qui reste sujette à une controverse doctrinale résultant de la confrontation de lectures émanant de chercheurs dans le domaine des sciences juridiques, en particulier, et des sciences sociales, en général.
Il est question, de ce fait, de mettre en évidence le problème traité dans une recherche qui se limite, pour la première, à un énoncé sous la forme d'une courte phrase, qui expose la question centrale qui, à son tour, détermine l'objectif de la recherche.
Pour cette dernière, cependant, il est présenté sous la forme d'une initiative intellectuelle et méthodologique complexe induisant un cheminement spécifique du sujet de recherche, des questions qu'il soulève et des hypothèses qu'il formule.
Il exige la justification de l'utilisation d'idées qui sont parfois divergentes pour mettre en évidence les liens logiques entre les éléments et conditions d'un sujet de recherche.
