تخضع الأخلاقيات الحيوية لمبادئ دستورية محددة يأتي في مقدمتها مبدأ احترام الكرامة الإنسانية الذي يمثل أساسا لحماية السلامة الجسدية في ظل التطورات العلمية المتلاحقة للتقنيات الحيوية.
و نظرا للخطورة المحتملة لهذه التقنيات فإن مشروعيتها تخضع للغاية التي يحددها المشرع من جهة و احترام حرية الأفراد باشتراط موافقتهم الصريحة من جهة أخرى لذا يعد مبدأ الحرية الفردية المبدأ الثاني الذي يحكم الأخلاقيات الحيوية.
Abstract EN
Clear-cut constitutional principles regulate bioethics.
High on the list, the principle of human dignity constitutes the foundation stone for the protection of the physical integrity in light of the scientific advances in biotechnology.
Furthermore, bearing in mind the danger the techniques of biotechnology may potentially pose, their legal use is conditioned by the objectives as defined by the legislator on the one hand, and by respecting the individual’s fundamental freedoms through the requirement of a prior explicit consent, on the other.
Therefore, the individual freedom is to be regarded as the second principle regulating bioethics.

La bioéthique est soumise à des principes constitutionnels précis.
Au premier rang, figure le principe de dignité humaine qui constitue le fondement même de la protection de l’intégrité physique à la lumière des développements scientifiques successifs de la biotechnologie.
Par ailleurs, et compte tenu du danger que peut potentiellement constituer les techniques de biotechnologie, leur utilisation légale est conditionnée par l’objectif tel que défini par le législateur d’une part, et par le respect de la liberté des individus à travers l’exigence d’un consentement préalable et explicite d'autre part.
Par conséquent, la liberté individuelle constitue le deuxième principe régissant la bioéthique.
