Abstract EN

This study aims to reveal the controls governing the declaration of war in the Algerian constitution, which explicitly stipulated that the President of the Republic has the authority to declare war in the event of actual aggression against the country or is about to happen.

In the first topic we tried to address the declaration of war in its traditional and modern concept to define The point of the constitutional founder and revealing the difference between the two concepts, then in the second topic, the formal and substantive measures that precede the declaration of war are discussed, with commentary on the articles related to the subject of the preliminary draft to amend the constitution.
