Abstract EN

The Algerian legislator has recognized the ability of natural and Juristic persons to resort to international commercial arbitration through Articles (1006) and (1039) of the Civil and Administrative Procedures Law, dedicating in the principle of the power of will and therefore the contract (arbitration agreement) resulting in a judgment.

However, this judgment differs from the judicial judgment in terms of the binding force and procedures for its implementation due to its specificity and the arbitrator's lack of commanding authority, which requires the intervention of the judiciary to provide binding force and maintain the international judgment by arbitration in the executive form so that it is an enforceable bond in accordance with article (600) of the Civil and Administrative Procedures Law, and what has been delivered by the New York Convention concerning the recognition and implementation of the foreign Judgment by arbitration.
