يهدف هذا البحث إلى إيضاح مسألتين مهمتين متعلقتين بالنوازل و هما : الأولى : التعرف على مفهوم النوازل و أنها تعني الوقائع المستجدة التي لا نص فيها و لا اجتهاد سابق فهي بهذا أخص من الفتاوى التي تعني الجواب عن المسائل القديمة و الجديدة.
و الثانية : مراحل النظر في النوازل و تعني المسار الذي ينبغي للمجتهد أن يسلكه للوصول إلى الحكم الشرعي و هو : تصور النازلة و تكييفها فقهيا ثم التنزيل.
Abstract EN
This research aims at clarifying two important things related to New Issues: The first is to know the concept of New Juristic Issue, which means looking for solutions to new problems, other than fatwas, designed to answer to new and old problems.
The second is Steps to consider new issues.
This means the path that the researcher must follow to reach Islamic law.
