إن مبدأ حياد الإدارة هو ركن من أركان الدولة العصرية و هو أحد الشروط الأساسية للمشروعية الحقيقية للمرفق العام التي يجب أن يتحلى بها باعتبارها جزء لا يتجزأ من مقتضيات مهامه دون تمايز بين المرتفقين فهو مبدأ قوامه إبعاد المرفق عن الحسابات السياسية و الاعتبارات الحزبية و التقيد بالمعايير المهنية والموضوعية و الحيادية في تنفيذ وضمان حيادته و نزاهته غير أن هذه المبادئ و الاعتبارات يمكن أن تحيد عن مبدأ حياد الإدارة ما يدفعنا إلى البحث عن مدى وضع المشرع لضمانات دستورية و قانونية تضمن تطبيق هذا المبدأ في جميع الأحوال.
Abstract EN
Principle of neutrality of the administration is one of the characteristics of a modern state, it is based on justice and equality between the beneficiaries of public utility services utility without distinction.
In this study, I looked closely at the extent to which the legislator has established constitutional and legal guarantees to ensure that the principle of administration neutrality.is achieved in all cases.
