Abstract EN

The legislative competence of the state council before 2016 consisted in the approval of the legal texts returned from the National People's Congress, without being entitled to make proposal or amendment, which paralyzes the activity of the second chamber and which created a reflection to the constitutional legislator to update and strengthen this role through the amendment of the constitution of Algeria in 2016, having attributed to the lower house wide powers in the legislative field, forcing the government to deposit the bills in three special areas as an obligation to the office of the council of state, in addition to the allocation to the 20 members of the second chamber the right to propose laws in these areas as well as the right to amend them, which is another brick and a serious step on the part of the legislator of the Algerian constitution to set in motion the parliament and to achieve quality in the legislative texts.

The text of the research addresses the question of the expected spheres of the constitutional amendment of 2016 on the legislative function of the state council and the repercussions that may result from these new powers that were not granted to the chamber of higher degree throughout twenty or so years since its foundation.
