يعد الشرط المعفي من المسؤولية العقدية من الشروط التي أقرها الفقه و القانونفطالما أن أحكام المسؤولية العقدية ليست من النظام العام فيجوز للمتعاقدين تعديل أحكامها و تضمين عقودهم بالاتفاقات المعدلة للمسؤولية سواء من خلال الاتفاق على التخفيف و كذا التشديد من المسؤولية العقدية أو الإعفاء منها كليا و هذا الأخير هو محور دراستنا فقد أقرت التشريعات بصحة هذا الاتفاق المعفي الذي من شأنه رفع المسؤولية عن المدين فلا يكون بذلك مسئولا بتعويض الدائن عما أصابه من ضرر.
جاءت هذه الدراسة تهدف إلى معرفة مفهوم الاتفاق المعفي من المسؤولية و تطبيقاته و كذا تبيان القيود الواردة عليه المتمثلة في الغش و الخطأ الجسيم و عدم مخالفة هذا الاتفاق للنظام العام و الآداب العامة و كذا الالتزام الجوهري للعقد هذا بالإضافة إلى تحليل المواد التي جاء بها المشرع الجزائري في هذا الموضوع
Abstract EN
The condition exempt from contractual liability is one of the conditions approved by jurisprudence and law, since the provisions of contractual liability are not of the public order, the contracting parties, may amend their provisions, whether through relaxing its provisions or exemption from it entirely the latter is the focus of our study, legislation recognized validity of this agreement which exempts debtor from liabilityThis study aims to know the concept of an exempt agreement, and to clarity restrictions contained on it, represented in fraud, critical error, and not to violate public order and public morals, and the essential commitment in the contract, and analysis of the articles brought about on this subject.
