With the end of the twentieth century and the beginning of this century, the world witnessed a great development in the means of communication that had a great impact on the economic, social and legal aspects, so these modern communication technologies became irreplaceable in various transactions, including the contractual field, so the term e-contract appeared, and its consequences Problems due to the privacy it is characterized byAs a result, the countries initiated legislation to regulate this type of contract, and therefore the aim of the research is to clarify the position of the Algerian legislator regarding the regulation of the electronic contract, which was not devoted to electronic contracting detailed and comprehensive regulation in the Algerian civil codification, especially in the stage of electronic negotiation, as well as defining The time and place of concluding the electronic contract, and we reached the conclusion that the principle of the will to activate the determination of the time and place of concluding the electronic contract must be activated, with the need for amendments to the Contract and Obligations Law, to keep pace with economic and social development, and to achieve legal security.
