The guardianship is a legitimate that the wise legislator enact judicious and the Algerian legislator have delegated to the guardian in exercising this right in order to preserve the interests of women and their maintenance.

The importance of this study highlights that, despite the important position that the wise legislator granted to the father and represented in the right to assume directly the marriage of the interested, this right was legitimized as a means to an end which is the fulfillment of the purpose of legislator and then the Algerian legislator from this ruling, as well as for the husband, despite the advantage that he gave He has the wise legislator and the Algerian legislator in using the right of guardianship over women, The aim of this study is to focus on images of abuse of the guardian in the use of the right of guardianship over women through the definition of arbitrariness on the right of the guardianship of marriage, as well as abuse of the husband in his use of the right of absolute guardianship and wealso note the role of the Algerian Family Law in protecting women from the arbitrariness of both the guardian and the husband in the use of the right to guardianship
