Abstract EN

The subject of this research is an Islamic jurisprudential adaptation of moral objects and related rights, such as book writing, press writing, advertising, audio-visual production, electronic digital programming, real-life embodiment (representation and application), trademarks, trade names, trade address (trade mark), commercial reputation, trade license, trade secrets and data.

Trade, geographical indications (certificate of origin), industrial designs, industrial designs, schematic designs of integrated circuits, plant varieties, etc.

M so far, one of this section, all moral things (non-material); in the sense that they understood and intended objects of the word and custom, not Oaaana tangible concrete.

I discuss the difference between the material and moral thing and what they are attached to, and then discuss the views of the jurists old and new and I deduce what I conclude by the book and the Sunnah and consensus and custom, and then I achieve the fact that the ownership of the law with evidence.

The research has concluded important results are: the distinction between the material and the intangible thing, and the limitation of the intangible things and the rights related to them, and their legal conditioning, so it was decided that the possession of the intangible things and the rights related to them is an imperfect property (limited or conditional).
