The study of Order N°03/03 on competition shows that the principle of prohibition of anticompetitive cartels and abuse of dominant position in the market is confirmed, but, however, without this being an olute principle, it is restricted.

These restrictions carry exceptions which result from the legislation or from the contribution of these anticompetitive practices to economic and technical progress on the one hand, and on the other hand, these restrictions are in the form of negative attestations regulated by the Algerian legislator in accordance with Executive Decree N°05/175 laying down the procedures for obtaining negative clearance with regard to cartels and the dominant position on the market.
