تترك جرائم الإرهاب آثارا جسيمة سواء من الناحية البشرية المادية أو المعنوية بالرغم من ذلك لم يتفق أعضاء المجتمع الدولي على وضع تعريف موحد لها فغالبا ما يكون للتجاذبات السياسية دور كبير في فرض وجهات النظر في الطرح و الاختلاف حول المفاهيم المرتبطة بوضع تعريف موحد للإرهاب و بالتالي صعوبة إيجاد الآليات الكفيلة بمجابهته دوليا.
الهدف من دراستنا هاته هو محاولة الوصول لأسباب عدم وضع مفهوم موحد للإرهاب خاصة الإرهاب الدولي و الآليات المتاحة أو الممكنة لمجابهته باعتباره جريمة دولية مع اعطاء فرضيات كاعتباره كجريمة قائمة بحد ذاته أو اعتباره قصد جنائي خاص لجرائم قائمة أصلا يتوجب مضاعفة العقوبة عليها لنصل إلى إعطاء النقاط المشتركة في جرائم الإرهاب محل إجماع و الوصول لنتيجة عدم اختصاص المحكمة الجنائية الدولية بجرائم الإرهاب ووجوب تعديل أحكام النظام الأساسي لها مع تشريح دور المحكمة الدولية الخاصة بلبنان
Abstract EN
Despite the ugliness of the acts that are described as terrorist crimes and the effects they leave in terms of human, material and moral losses, members of the international community have not agreed on formulating an overarching definition of it, so political, ideological, and even interests of interests often have a major role in imposing views on the proposition and the difference in Concepts related to developing a unified definition of terrorism, and therefore the difficulty of finding mechanisms to counter it internationally.
The aim of the study is to try to reach the reasons for not establishing a unified concept of terrorism, while giving hypotheses to answer by considering it as an existing crime in itself, or as a special criminal intent for already existing crimes that must double the penalty, and reaching the concept of terrorism The international community and knowing the available and possible mechanisms to combat it as an international crime by setting the hypothesis of the jurisdiction of the International Criminal Court for terrorism crimes, and dissecting the role of the International Special Tribunal for Lebanon, to reach the result of the lack of jurisdiction of the International Criminal Court with terrorist crimes and the necessity of amending the provisions of the system Its primary.
