This research paper aims to offer the balance between international rule on her sides customary and agreed its basis by the right of humanitarian aid, in accordance with texts of agreements of geneva for the year 1949 and their two supplement protocols for the year 1977 and the considred the infringement of international legitimacy, and the principle from human principles of united nation sits basis by the human intervention guaranteed by the rules of public international law in his agreed side ,and his application is an infringement of the international sovereign rights, so that’s show us at first the size of inconsistency if combines the application of this facts in the contemporary international practices, for adjust the result of this problem, must the international community countries and international organization governmental and nogovernmental the principal responsibility to applicate the right of humanitarian aid, and if the receiving refuse must be presented the solutions beginning with the diplomatic solution to offering assistance and finished by human intervention to force the right of humanitarian aid, so the fail of country to avoid the humanitarian tragedy leads us to show the human intervention tagged with legitimacy for humanitarian reasons.
