Parliament has an important role in contemporary constitutional systems as the expression of the will of the nation, and the embodiment of its wishes and demands.

This is done through the keenness of the constituent members of the Legislative Council to perform the duty entrusted to them.

To ensure effective participation in the enactment of laws and the strict control over the work of the executive power through the available legal means.

It is noticeable in many countries, that the role of the parliament is declining and the executive authority dominates the rest of the state, One of the reasons that led to this situation is the failure of MPs to fulfill their role and their absence from the work of parliament, and the absence of a deterrent that forces MPs to abide by their duties, I have tried through this research to analyze the phenomenon of the absence of deputies in the parliament Algeria, indicating its causes and impact, as well as justifications and penalties prescribed by law in the case of absence.
